Why red-light cameras are so often contestable

The decisive question is: how long was the light actually red? The answer depends on induction loops, the light control unit and documentation. Typical weak points:

  • Red time not documented to the second – but the “more than 1 second” threshold is decisive
  • Amber phase shorter than prescribed (depends on the permitted speed)
  • Sensor loops positioned incorrectly or triggered in error
  • Emergency-like situations (e.g. making way for rescue vehicles)
  • Driver not clearly identifiable on the photo

What is a “qualified” red-light violation?

When the light had already been red for more than 1 second as you crossed the stop line. Then you face a €200 fine, 2 points and a 1-month driving ban – considerably more than for a simple red-light violation.

How is the red time even measured?

Via induction loops in the road and the traffic light control unit. This is exactly where frequent errors occur: incorrectly calibrated loops, amber phases that are too short, or poorly documented red times.

The red-light camera flashed me – am I automatically guilty?

No. The camera also triggers if you stop behind the line or were allowed to turn. Whether a chargeable violation exists only becomes clear when the photo and measurement data are analysed.

Can there be criminal consequences if someone was endangered?

A qualified red-light violation with endangerment can constitute a criminal offence under sec. 315c StGB – with a fine or imprisonment and revocation of your licence. At the latest then you should get a defence lawyer.

What about the green arrow sign?

With the green arrow sign you must come to a complete stop before turning right. Failing to stop costs €70, with endangerment up to €150 – each with 1 point.
