Appeal against the fine notice: Deadline, procedure, costs

The most important deadline first: two weeks
You can file an appeal (Einspruch) against a fine notice (Bußgeldbescheid) within two weeks of service (sec. 67 OWiG). What counts is the date on the yellow envelope – not the date printed in the notice. If you miss the deadline, the notice becomes final and binding: the fine, points and any driving ban (Fahrverbot) are then fixed.
Deadline almost up? Then do not rely on the post – file the appeal by fax or directly with the authority, or submit your case to us right away and we will take care of meeting the deadline.
How the appeal proceeds
- File the appeal – in writing with the fine authority, no particular form and initially no reasons required. One sentence is enough.
- File inspection (Akteneinsicht) – the decisive step, which only a lawyer can take in full: the measurement log, calibration certificate, training certificates and speed camera photo are requested and examined.
- Statement or withdrawal – if errors are found, the authority is confronted with them. It can withdraw the notice or discontinue the proceedings.
- Court proceedings – if the authority does not allow the appeal, the local court (Amtsgericht) decides. Here too, a large share of proceedings are discontinued or end with a milder outcome. And no need to worry about the hearing: in most cases you do not have to appear in person.
What can an appeal achieve?
- Discontinuation of the proceedings – in the event of measurement or procedural errors or limitation
- Reduction – for instance from a driving ban to an increased fine
- No points – important if your points account is already filling up
An appeal can be worthwhile even if the allegation is essentially true – for example to avert a driving ban if you depend on your car for work.
What does it cost?

A common mistake: “explaining” yourself
Do not draft your own justification in the hearing form (Anhörungsbogen) or the appeal (“It was me, but…”). Such statements can hardly be taken back later. Have it reviewed first, then respond – or better still: have us respond for you.
