Legal expenses insurance in fine proceedings: What it really pays

Yes – the motor legal protection module (Verkehrsrechtsschutz) of a legal expenses insurance (Rechtsschutzversicherung) covers the defence in regulatory offence proceedings: lawyer fees, court costs and usually also expert opinions on the measurement. Those expert opinions are often the key to a successful appeal (Einspruch) – and barely affordable privately.

Important: There is no “prospects of success” test as in civil law – in the fines area, insurers usually grant cover confirmation as a matter of course.

What you may not know: you are insured more often than you think

  • through your partner or family (family tariff)
  • through the keeper of the vehicle (vehicle-based tariffs also protect the driver)
  • through automobile clubs (ADAC & co. offer legal protection modules)
  • through your employer in the case of a company car

Deductible and premium increases

Depending on the tariff, a deductible (often 150–300 €) applies. Many tariffs waive it for certain services, and unlike motor liability insurance, legal expenses insurance has no no-claims classes in the strict sense – a single cover enquiry does not normally lead to termination. Whether making a claim is worthwhile is something we discuss with you openly.

Even without insurance, the initial review is free. If an appeal is worthwhile, you receive a fixed-price quote in advance based on the statutory fees – you decide with all the numbers on the table. Consider the flip side: a final fine notice costs not only the fine itself, but possibly points, higher insurance premiums and, in the worst case, your driving licence.
