The most common points of attack in speed measurements

  • Measurement log and calibration certificate: if they are missing or incomplete, the measurement is shaky.
  • Location and distance: depending on the federal state, minimum distances to the speed limit sign apply.
  • Operator training: without proof of training, the measurement is contestable.
  • Camera photo: blurry photo or covered face – the authorities must prove you were driving.
  • Raw measurement data: for some device types, verifiability after the fact is disputed.

I was flashed by a speed camera – when will the notice arrive?

Usually within a few weeks. Important: since 01.07.2026 the limitation period for prosecution is a uniform 6 months (sec. 26 para. 3 StVG) – if no notice arrives and nothing interrupts the period (e.g. a hearing form), prosecution generally becomes time-barred.

How much tolerance is deducted from a speed measurement?

For measured speeds below 100 km/h, 3 km/h is usually deducted; above that, 3%. Higher deductions apply to certain measurement methods (e.g. following in a police car).

When does a driving ban loom?

Standard driving ban: from 31 km/h over the limit in town, from 41 km/h out of town. From 26 km/h over, a ban already looms if another violation of 26 km/h or more became final within the previous year.

Is an appeal against a speed camera notice worthwhile?

It depends on the individual case: the measurement method, measurement log, calibration, signage and photo are typical points of attack. That is exactly what the free initial review is for – especially important if points or a driving ban are at stake.

As the vehicle owner, do I have to reveal who was driving?

No. As the accused you are not required to incriminate yourself, and close relatives may refuse to testify. Have anything you plan to state in the hearing form reviewed first.
